Question about posting puzzles on this site

Should puzzles we intend to sell be posted here for critique? Would that be considered "publishing" them? The NYT sheet says:

"Times puzzles must never have been published anywhere before, either in print or electronically. The Times buys all rights, including first rights."

Is this a concern?
