Title: Definition of "Published" and first rights

I thought I had seen this question answered somewhere on Cruciverb, but now can't find it.

What exactly does the requirement of not having been published mean?

If I post a puzzle on the critique section here, can I no longer submit it?

Can I still issue it to my test group? (~3-5 people)

In the NYT spec sheet (but not in the contract that I signed with them) it says: "Times puzzles must never have been published anywhere before, either in print or electronically." Similar wording is in the contracts that I have with various publishers.

Sending the puzzle to colleagues of yours for review wouldn't constitute publishing, but posting on this site might, since it can be accessed by any visitor to the site.
